Partner (Provisional and Migrant) visa (subclass 100)

This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia temporarily. Getting this visa is the first step towards a permanent Partner visa (subclass 100).

Stay : Temporarily until your permanent Partner visa (subclass 100) application is finalized or you withdraw your application.

Cost : From AUD8,850.00

With this visa you can

  • live, work and study in Australia while Australia process your permanent Partner visa
  • travel to and from Australia as many times as you want
  • attend free English language classes provided by the Adult Migrant English Program if you are eligible
  • apply for access to Australia's public health care scheme, Medicare.

You must

  • be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
  • have your spouse or de facto partner sponsor you
  • be outside Australia when you apply for this visa. Family who apply with you must also be outside Australia.

The Department is not asking Family visa applicants (including subclass 309/100 applicants) to travel offshore for the grant of their visa at this time.

To be eligible for this visa you must:

  • not had a visa canceled or an application refused
  • be outside Australia when you apply
  • have a sponsor
  • be the right age
  • meet relationship requirements
  • meet our health requirement
  • meet our character requirement
  • have no debt to the Australian Government
  • best interests of the child.

Partner (Provisional and Migrant) visa (subclass 309)

The visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen, live in Australia permanently. It is usually granted to people who hold a temporary Partner visa (subclass 309).

  • You must hold a temporary Partner visa (subclass 309)

Stay : Permanently.

Cost : You paid for this visa when you made your combined application for the temporary and permanent partner visas.

With this visa you can

In addition to what you can do on your subclass 309 visa, you can:

  • live, work and study in Australia indefinitely
  • sponsor eligible family members to come to Australia
  • apply for Australian citizenship if eligible.

You must

  • hold a temporary Partner (Provisional) visa (subclass 309) or Dependent Child visa (subclass 445)
  • in most cases, continue to be in a genuine and ongoing relationship with your partner

Visa requirements

You must hold:

  • a Partner (Provisional) visa (subclass 309), or
  • a Dependent Child (subclass 445) visa.

2 years must have passed since you applied for the combined 309 and 100 visa for you to be assessed for the permanent visa.

If you Australiare in a long-term relationship or your sponsor held a specific visa before you applied, you might be granted the permanent visa within less than 2 years. Australia will let you know if this applies to you.

Continue to meet relationship requirements:

You must continue to be the spouse or de facto partner of the same person who sponsored you for the temporary Partner visa.

You must:

  • be married or in a de facto relationship
  • have a genuine and continuing relationship
  • live together or don’t live permanently apart
  • be mutually committed to a shared life excluding other partners.
